Background 

The Norwegian Refugee Council is an international, independent, humanitarian, non-governmental organization that provides assistance to refugees’ and internally displaced people in many countries worldwide including Libya. As a part of its assistance, NRC provides information, counselling and legal assistance (ICLA) services to empower beneficiaries and support them to claim and exercise their rights. NRC beneficiaries include: Refugees, internally displaced people, and members of host community.

In order to achieve these aims, NRC’s ICLA programme is seeking a consultant to provide legal services to beneficiaries, and provide specialised legal advice to the ICLA team on legal issues relevant to refugees and internally displaced people.

Expected Outcomes  

Set out below is a non-exhaustive list of the legal work anticipated as part of the consultancy:
–          Conduct group legal information sessions with clients on relevant topics;
–          Consult with individual clients on their legal issues;
–          Provide clients with legal advice and representation in both formal and informal dispute resolution such as negotiation with third parties on behalf of beneficiaries, and representation before courts and government bodies;
–          Provide the ICLA team with technical advice, research and analysis of case law and legislation relevant to internally displaced people, refugees and other vulnerable people;
–          Prepare factsheets, brochures and other information material on legal rights
–          Work with other lawyers, and relevant actors, to advocate on key legal issues and construct solid legal arguments and strategies for cases, using applicable domestic and international law as necessary;
–          Identify potential legal cases;
–          Attend workshops, seminars and training sessions conducted by NRC
–          Provide the ICLA team with legal information and updates on relevant issues;
–          Maintain all relevant paperwork and update databases as needed;
–          Work on other tasks as needed.

– تزويد العملاء بالمشورة والتمثيل القانونيين في كل من تسوية المنازعات الرسمية وغير الرسمية مثل التفاوض مع أطراف ثالثة نيابة عن المستفيدين ، والتمثيل أمام المحاكم والهيئات الحكومية ؛
– -تزويد فريق (ايكلا) بالمشورة الفنية والبحوث وتحليل السوابق القضائية والتشريعات ذات الصلة بالنازحين داخليا واللاجئين وغيرهم من الفئات المستضعفة
– إعداد صحائف ووقائع وكتيبات ومواد إعلامية أخرى عن الحقوق القانونية
– العمل مع محامين آخرين ، والجهات الفاعلة ذات الصلة ، للدفاع عن القضايا القانونية الرئيسية وبناء حجج واستراتيجيات قانونية قوية للقضايا ، باستخدام القانون المحلي والدولي الواجب التطبيق حسب الضرورة ؛
– تحديد القضايا القانونية المحتملة
-حضور ورش العمل والندوات والدورات التدريبية التي يعقدها المجلس النرويجي
– تزويد فريق ايكلا بالمعلومات القانونية والتحديثات حول القضايا ذات الصلة ؛
-الحفاظ على جميع الأوراق ذات الصلة وتحديث قواعد البيانات حسب الحاجة – العمل على مهام أخرى حسب الحاجة

Qualifications
 
–          A university degree in law.
–          An active license from the Libyan Bar Association to practice law in Libya and proceed with the legal procedures before the courts. Candidates who have completed a law degree but are not actively registered with the Libyan Bar Association will not be considered.
–          Verbal and written fluency in Arabic. English highly desirable.
–          Proven experience and speciality in one of the following areas of law:
Housing, land and property
Legal residency and work rights for non-Libyans
Personal status laws
–          Committed to working with internally displaced people, refugees and other vulnerable people; and supporting them to exercise their legal rights.

The lawyer will be working independently and relying on own vehicle/computer or any other logistic arrangement needed.

مؤهلات

– إجازة جامعية في القانون
-ترخيص فعال من نقابة المحامين الليبيين لممارسة المحاماة في ليبيا والمضي قدما في الإجراءات القانونية أمام المحاكم. لن يتم النظر في المرشحين الذين أنهوا شهادة في القانون ولكنهم غير مسجلين حاليا في نقابة المحامين الليبية
– الطلاقة اللفظية والكتابية باللغة العربية. الإنجليزية مرغوب فيه للغاية
– خبرة مثبتة وتخصص في أحد مجالات القانون التالية:
1. السكن والأرض والملكية.
2. الإقامة القانونية وحقوق العمل لغير الليبيين
3. الالتزام بالعمل مع النازحين واللاجئين وغيرهم من الأشخاص الضعفاء ؛ ودعمهم لممارسة حقوقهم القانونية.
سوف يعمل المحامي بشكل مستقل. فيما يتعلق بالترتيبات اللوجستية, لا يتم توفير سيارة او كمبيوتر شخصي من قبل المنظمة بل يجب على من يتم توظيفه توفيرها.
