Background 

The Norwegian Refugee Council is an international, independent, humanitarian, non-governmental organization that provides assistance to refugees, migrants and internally displaced people in many countries worldwide including Libya. As a part of its assistance, NRC provides information, counselling and legal assistance (ICLA) services to empower beneficiaries and support them to claim and exercise their rights. NRC beneficiaries include: Refugees, internally displaced people, migrants and members of host community.

In order to achieve these aims, NRC’s ICLA programme is seeking a consultant to provide legal services to beneficiaries, and provide specialised legal advice to the ICLA and Education team on child rights. The main focus of the work of this consultancy will be the right to education, and advising parents on access to education.

Expected Outcomes

Set out below is a non-exhaustive list of the legal work anticipated as part of the consultancy:
–          Consult with individual clients on their legal issues;
–          Provide clients with legal advice and representation in both formal and informal dispute resolution such as negotiation with third parties on behalf of beneficiaries, and representation before courts and government bodies;
–          Provide the ICLA team with technical advice, research and analysis of case law and legislation relevant to child rights and legal protections for children;
–          Prepare factsheets, brochures and other information material on legal rights
–          Liaise with the Ministry of Education and other partners on pathways to enrolment for out of school children;
–          Liaise with foreign Embassies on access to documentation for migrant children in Libya;
–          Work with other lawyers, and relevant actors, to advocate on key legal issues and construct solid legal arguments and strategies for cases, using applicable domestic and international law as necessary;
–          Identify potential legal cases;
–          Attend workshops, seminars and training sessions conducted by NRC
–          Provide the ICLA team with legal information and updates on relevant issues;
–          Maintain all relevant paperwork and update databases as needed;
–          Work on other tasks as needed.

-إعداد صحائف ووقائع وكتيبات ومواد إعلامية أخرى عن الحقوق القانونية.
-الاتصال بوزارة التربية والتعليم والشركاء الآخرين بشأن مسارات الالتحاق بالمدارس خارج المدارس.
-التنسيق مع السفارات الأجنبية بشأن الحصول على الوثائق للأطفال المهاجرين في ليبيا.
-العمل مع المحامين الآخرين ، والجهات الفاعلة ذات الصلة ، للدفاع عن القضايا القانونية الرئيسية وبناء حجج واستراتيجيات قانونية قوية للقضايا ، باستخدام القانون المحلي والدولي المعمول به عند الضرورة.
-تحديد القضايا القانونية المحتملة.
-حضور ورش العمل والندوات والدورات التدريبية التي تجريها المجلس النرويجي.
-تزويد فريق المعلومات والاستشارة والمساعدة القانونية بالمعلومات القانونية والتحديثات بشأن القضايا ذات الصلة.
-الحفاظ على جميع الأوراق ذات الصلة وتحديث قواعد البيانات حسب الحاجة. -العمل في مهام أخرى حسب الحاجة

Job Requirements

–          A university degree in law.
–          An active license from the Libyan Bar Association to practice law in Libya and proceed with the legal procedures before the courts. Candidates who have completed a law degree but are not actively registered with the Libyan Bar Association will not be considered.
–          Verbal and written fluency in Arabic. English highly desirable.
–          Proven experience and speciality in one of the following areas of law:
Personal status laws
Child rights, custody and guardianship
–          Committed to working with internally displaced people, refugees and other vulnerable people; and supporting them to exercise their legal rights.

مؤهلات

-شهادة جامعية في القانون
-ترخيص نشط من نقابة المحامين الليبيين لممارسة المحاماة في ليبيا والمضي قدما في الإجراءات القانونية أمام المحاكم.
-لن يتم النظر في المرشحين الذين أنهوا شهادة في القانون ولكنهم غير مسجلين بنشاط في نقابة المحامين الليبية
-طلاقة لفظية ومكتوبة باللغة العربية. الإنجليزية مرغوب فيه للغاية
-خبرة وتخصص مثبت في أحد مجالات القانون التالية:
1. قوانين الأحوال الشخصية
2. حقوق الطفل والحضانة والوصاية
الالتزام بالعمل مع النازحين واللاجئين وغيرهم من المستضعفين ؛ ودعمهم لممارسة حقوقهم القانونية
